Release Forms for Members

An Adult Dependant is an immediate family member between the ages of 18 and 23 and enrolled as a full time student or active duty military personnel and remaining under a parent/guardian’s BMC membership.

IN CONSIDERATION of my membership in the Billings Motorcycle Club, I / we agree that for all members of our household, including our Adult Dependent and under circumstances that I / we exclusively control our Adult Dependent (hereinafter referred to collectively as “the Adult Dependent”) being permitted to watch, help, provide assistance or participate in any way in any activity on BMC grounds, including but not limited to attending competitive racing events (hereinafter referred to collectively as “Event(s)”) and/or being permitted to enter for any purpose any portion of the BMC grounds (hereinafter referred to collectively as “Restricted Area(s)”):

1. I / we know the nature of any activity involving motorized vehicles, including Events, and the Adult Dependant’s experience and capabilities, and believe the Adult Dependant to be qualified to participate in the Event(s) held on or near Restricted Areas. I will inspect the premises, facilities, and equipment to be used, or with which the Adult Dependant may come in contact. IF I / WE OR THE ADULT DEPENDANT BELIEVE ANYTHING IS UNSAFE, I / WE WILL IMMEDIATELY LEAVE THE RESTRICTED AREA AND REFUSE TO PARTICIPATE FURTHER IN THE EVENT(S) AND INSTRUCT THE ADULT DEPENDANT TO DO SO IMMEDIATELY.

2. I / WE FULLY ACCEPT AND UNDERSTAND and will instruct the Adult Dependant that: (a) THE ACTIVITIES OF THE EVENT(S) ARE INHERENTLY DANGEROUS and participation in the Event(s) and/or entry into Restricted Areas involves RISKS AND DANGERS OF SERIOUS BODILY INJURY, INCLUDING PERMANENT DISABILITY, PARALYSIS AND DEATH (“RISKS”); (b) these Risks and dangers may be caused by my / our and / or the Adult Dependant’s own actions, or inactions, the actions or inactions of others participating in the Event(s), the rules of the Event(s), the condition and layout of the premises and equipment, or THE NEGLIGENCE OF THE “RELEASEES” NAMED ABOVE; (c) there may be OTHER RISKS NOT KNOWN TO ME / US or that are not readily foreseeable at this time; and (d) THE SOCIAL AND ECONOMIC LOSSES and/or damages that could result from those Risk(s) COULD BE SEVERE AND COULD PERMANENTLY CHANGE MY / OUR and / or the ADULT DEPENDANT’S FUTURE.

3. I consent to my / our and the Adult Dependant’s participation in the Event(s) and/or entry into restricted areas and HEREBY ACCEPT AND ASSUME ALL SUCH RISKS, KNOWN AND UNKNOWN, AND ASSUME ALL RESPONSIBILITY FOR THE LOSSES, COSTS AND/OR DAMAGES FOLLOWING SUCH INJURY, DISABILITY, PARALYSIS OR DEATH, EVEN IF CAUSED, IN WHOLE OR IN PART, BY THE NEGLIGENCE OF THE “RELEASEES” NAMED BELOW.

4. I HEREBY RELEASE, DISCHARGE AND AGREE TO HOLD FULLY HARMLESS AND INDEMNIFY Billings Motorcycle Club, Inc., its members, officers and directors, the promoters, participants, racing associations, sanctioning organizations or any subdivision thereof, track operators, track owners, officials, bike owners, drivers, pit crews, rescue personnel, any persons in any Restricted Area, promoters, sponsors, advertisers, owners and lessees of premises used to conduct the Event(s), premises or event inspectors, surveyors, underwriters, consultants and other persons or entities who give recommendations, directions, or instructions or engage in risk evaluation or loss control activities regarding the premises or Event(s) and each of them, their directors, officers, agents, and employees, all for the purposes (hereinafter referred to collectively as “Releasees”) FROM ALL LIABILITY TO ME / US and THE ADULT DEPENDANT, my / our and the Adult Dependant’s personal representatives, assigns, heirs, and next of kin, FOR ANY AND ALL CLAIMS, DEMANDS, LOSSES, OR DAMAGES ON ACCOUNT OF ANY INJURY TO ME OR THE ADULT DEPENDANT, including, but not limited to, death or damage to property, CAUSED OR ALLEGED TO BE CAUSED, IN WHOLE OR IN PART, BY THE NEGLIGENCE OF THE “RELEASEES” OR OTHERWISE.

5. If, despite this release, I / we, the Adult Dependant, or anyone on the Adult Dependant’s behalf, makes a claim against of the “Releasees” referred to in this agreement, I / we AGREE TO INDEMNIFY AND SAVE AND HOLD HARMLESS THE RELEASEES and each of them from ANY LITIGATION EXPENSES, ATTORNEY FEES, LOSS, LIABILITY, DAMAGE, OR COST THEY MAY INCUR DUE TO THE CLAIM MADE AGAINST ANY OF THE RELEASEES” NAMED ABOVE, WHETHER THE CLAIM IS BASED ON NEGLIGENCE OF THE RELEASEES OR OTHERWISE.

I / we know the nature of any activity involving motorized vehicles, including Events, and the Minor’s experience and capabilities, and believe the Minor to be qualified to participate in the Event(s) held on or near Restricted Areas. I will inspect the premises, facilities, and equipment to be used, or with which the Minor may come in contact. IF I / WE OR THE MINOR BELIEVE ANYTHING IS UNSAFE, I / WE WILL IMMEDIATELY LEAVE THE RESTRICTED AREA AND REFUSE TO PARTICIPATE FURTHER IN THE EVENT(S) AND INSTRUCT THE MINOR TO DO SO IMMEDIATELY.

2. I / WE FULLY ACCEPT AND UNDERSTAND and will instruct the Minor that: (a) THE ACTIVITIES OF THE EVENT(S) ARE INHERENTLY DANGEROUS and participation in the Event(s) and/or entry into Restricted Areas involves RISKS AND DANGERS OF SERIOUS BODILY INJURY, INCLUDING PERMANENT DISABILITY, PARALYSIS AND DEATH (“RISKS”); (b) these Risks and dangers may be caused by my / our and / or the Minor’s own actions, or inactions, the actions or inactions of others participating in the Event(s), the rules of the Event(s), the condition and layout of the premises and equipment, or THE NEGLIGENCE OF THE “RELEASEES” NAMED ABOVE; (c) there may be OTHER RISKS NOT KNOWN TO ME / US or that are not readily foreseeable at this time; and (d) THE SOCIAL AND ECONOMIC LOSSES and/or damages that could result from those Risk(s) COULD BE SEVERE AND COULD PERMANENTLY CHANGE THE MY / OUR and / or the MINOR’S FUTURE.

3. I consent to my / our and the Minor’s participation in the Event(s) and/or entry into restricted areas and HEREBY ACCEPT AND ASSUME ALL SUCH RISKS, KNOWN AND UNKNOWN, AND ASSUME ALL RESPONSIBILITY FOR THE LOSSES, COSTS AND/OR DAMAGES FOLLOWING SUCH INJURY, DISABILITY, PARALYSIS OR DEATH, EVEN IF CAUSED, IN WHOLE OR IN PART, BY THE NEGLIGENCE OF THE “RELEASEES” NAMED BELOW.

4. I HEREBY RELEASE, DISCHARGE AND AGREE TO HOLD FULLY HARMLESS AND INDEMNIFY Billings Motorcycle Club, Inc., its members, officers and directors, the promoters, participants, racing associations, sanctioning organizations or any subdivision thereof, track operators, track owners, officials, bike owners, drivers, pit crews, rescue personnel, any persons in any Restricted Area, promoters, sponsors, advertisers, owners and lessees of premises used to conduct the Event(s), premises or event inspectors, surveyors, underwriters, consultants and other persons or entities who give recommendations, directions, or instructions or engage in risk evaluation or loss control activities regarding the premises or Event(s) and each of them, their directors, officers, agents, and employees, all for the purposes (hereinafter referred to collectively as “Releasees”) FROM ALL LIABILITY TO ME / US and THE MINOR, my / our and the minor’s personal representatives, assigns, heirs, and next of kin, FOR ANY AND ALL CLAIMS, DEMANDS, LOSSES, OR DAMAGES ON ACCOUNT OF ANY INJURY TO ME OR THE MINOR, including, but not limited to, death or damage to property, CAUSED OR ALLEGED TO BE CAUSED, IN WHOLE OR IN PART, BY THE NEGLIGENCE OF THE “RELEASEES” OR OTHERWISE.

5. If, despite this release, I / we, the Minor, or anyone on the Minor’s behalf, makes a claim against of the “Releasees” referred to in this agreement, I / we AGREE TO INDEMNIFY AND SAVE AND HOLD HARMLESS THE RELEASEES and each of them from ANY LITIGATION EXPENSES, ATTORNEY FEES, LOSS, LIABILITY, DAMAGE, OR COST THEY MAY INCUR DUE TO THE CLAIM MADE AGAINST ANY OF THE “RELEASEES” NAMED ABOVE, WHETHER THE CLAIM IS BASED ON NEGLIGENCE OF THE RELEASEES OR OTHERWISE.

IN CONSIDERATION of my membership in the Billings Motorcycle Club, I / we agree that for all members of our household, including all minor children, and under circumstances that I / we exclusively control our minor child or children (hereinafter referred to collectively as “the Minor”) being permitted to watch, help, provide assistance or participate in any way in any activity on BMC grounds, including but not limited to attending competitive racing events (hereinafter referred to collectively as “Event(s)”) and/or being permitted to enter for any purpose any portion of the BMC grounds (hereinafter referred to collectively as “Restricted Area(s)”):

1. I / we know the nature of any activity involving motorized vehicles, including Events, and the Minor’s experience and capabilities, and believe the Minor to be qualified to participate in the Event(s) held on or near Restricted Areas. I will inspect the premises, facilities, and equipment to be used, or with which the Minor may come in contact. IF I / WE OR THE MINOR BELIEVE ANYTHING IS UNSAFE, I / WE WILL IMMEDIATELY LEAVE THE RESTRICTED AREA AND REFUSE TO PARTICIPATE FURTHER IN THE EVENT(S) AND INSTRUCT THE MINOR TO DO SO IMMEDIATELY.

2. I / WE FULLY ACCEPT AND UNDERSTAND and will instruct the Minor that: (a) THE ACTIVITIES OF THE EVENT(S) ARE INHERENTLY DANGEROUS and participation in the Event(s) and/or entry into Restricted Areas involves RISKS AND DANGERS OF SERIOUS BODILY INJURY, INCLUDING PERMANENT DISABILITY, PARALYSIS AND DEATH (“RISKS”); (b) these Risks and dangers may be caused by my / our and / or the Minor’s own actions, or inactions, the actions or inactions of others participating in the Event(s), the rules of the Event(s), the condition and layout of the premises and equipment, or THE NEGLIGENCE OF THE “RELEASEES” NAMED ABOVE; (c) there may be OTHER RISKS NOT KNOWN TO ME / US or that are not readily foreseeable at this time; and (d) THE SOCIAL AND ECONOMIC LOSSES and/or damages that could result from those Risk(s) COULD BE SEVERE AND COULD PERMANENTLY CHANGE THE MY / OUR and / or the MINOR’S FUTURE.

3. I consent to my / our and the Minor’s participation in the Event(s) and/or entry into restricted areas and HEREBY ACCEPT AND ASSUME ALL SUCH RISKS, KNOWN AND UNKNOWN, AND ASSUME ALL RESPONSIBILITY FOR THE LOSSES, COSTS AND/OR DAMAGES FOLLOWING SUCH INJURY, DISABILITY, PARALYSIS OR DEATH, EVEN IF CAUSED, IN WHOLE OR IN PART, BY THE NEGLIGENCE OF THE “RELEASEES” NAMED BELOW.

I HEREBY RELEASE, DISCHARGE AND AGREE TO HOLD FULLY HARMLESS AND INDEMNIFY Billings Motorcycle Club, Inc., its members, officers and directors, the promoters, participants, racing associations, sanctioning organizations or any subdivision thereof, track operators, track owners, officials, bike owners, drivers, pit crews, rescue personnel, any persons in any Restricted Area, promoters, sponsors, advertisers, owners and lessees of premises used to conduct the Event(s), premises or event inspectors, surveyors, underwriters, consultants and other persons or entities who give recommendations, directions, or instructions or engage in risk evaluation or loss control activities regarding the premises or Event(s) and each of them, their directors, officers, agents, and employees, all for the purposes (hereinafter referred to collectively as “Releasees”) FROM ALL LIABILITY TO ME / US and THE MINOR, my / our and the minor’s personal representatives, assigns, heirs, and next of kin, FOR ANY AND ALL CLAIMS, DEMANDS, LOSSES, OR DAMAGES ON ACCOUNT OF ANY INJURY TO ME OR THE MINOR, including, but not limited to, death or damage to property, CAUSED OR ALLEGED TO BE CAUSED, IN WHOLE OR IN PART, BY THE NEGLIGENCE OF THE “RELEASEES” OR OTHERWISE.

5. If, despite this release, I / we, the Minor, or anyone on the Minor’s behalf, makes a claim against of the “Releasees” referred to in this agreement, I / we AGREE TO INDEMNIFY AND SAVE AND HOLD HARMLESS THE RELEASEES and each of them from ANY LITIGATION EXPENSES, ATTORNEY FEES, LOSS, LIABILITY, DAMAGE, OR COST THEY MAY INCUR DUE TO THE CLAIM MADE AGAINST ANY OF THE “RELEASEES” NAMED ABOVE, WHETHER THE CLAIM IS BASED ON NEGLIGENCE OF THE RELEASEES OR OTHERWISE.

IN CONSIDERATION of my minor child (“the minor”) being permitted to enter any area(s)owned by Billings Motorcycle Club, Inc (BMC) to take part in casual, non‐competitive riding of motorcycle and/or quads (referred to hereinafter as “rides”), I/we agree:

I/we, delegate full and complete responsibility for the care, safety and well‐ being of the minor child listed above to the BMC Member listed above for the purposes of casual, non-competitive “rides” on BMC owned property located in the South Hills area of Billings, Montana. This release agreement does not extend to any competition event, which is mutually agreed by the BMC Member and me/us. I/we understand that for the minor child to participate in a competition event, I/we must grant operator specific approval for such event(s) separate and apart from this agreement. I/we know the nature of the rides at the BMC grounds and the Minor’s experience and capabilities, and believe the Minor to be qualified to participate in these rides. The Sponsoring Member will inspect the premises, facilities, and equipment to be used, or with which the Minor may come in contact. I/we know and understand that the property to be ridden upon for the rides is undeveloped, unimproved and natural terrain. I/we understand that the condition of the trails, roads, and other surfaces change frequently due to weather and other reasons, and accept the inherently dangerous condition of the property. IF THE SPONSORING MEMBER, I/WE OR THE MINOR BELIEVE ANYTHING IS UNSAFE, THE MINOR WILL BE INSTRUCTED TO IMMEDIATELY LEAVE THE AREA AND REFUSE TO PARTICIPATE FURTHER IN THE RIDES.

I/we FULLY UNDERSTAND and will instruct the Minor and Sponsoring Member that: (a) THE ACTIVITIES OF THE RIDES ARE VERY DANGEROUS and participation in the rides and/or entry into the area involves RISKS AND DANGERS OF SERIOUS BODILY INJURY, INCLUDING PERMANENT DISABILITY, PARALYSIS AND DEATH (“RISKS”); (B) these Risks and dangers may be caused by the Minor’s own actions, or inactions, the actions or inactions of others participating in the rides, or the NEGLIGENCE OF THE “RELEASEES” NAMED BELOW; ( c ) there may be OTHER RISKS NOT KNOWN TO ME or the Releasees or that are not readily foreseeable at this time; (d) THE SOCIAL AND ECONOMIC LOSSES and/or damages that could result from those Risk(s) COULD BE SEVERE AND COULD PERMANENTLY CHANGE THE MINOR’S FUTURE.

I/we consent to the Minor’s participation in the rides and/or entry into the area and HEARBY ACCEPT AND ASSUME ALL SUCH RISKS, KNOWN AND UNKNOWN, AND ASSUME ALL RESPONSIBILITY FOR THE LOSS, COSTS AND/OR DAMAGES FOLLOWING SUCH INJURY, DISABILITY, PARALYSIS OR DEATH, EVEN IF CAUSED, IN WHOLE OR IN PART, BY THE NEGLIGENCE OF THE SPONSORING LIFE MEMBER OR THE “RELEASEES” NAMED BELOW.

I/WE HEREBY RELEASE, DISCHARGE AND HOLD HARMLESS the participants, bike owners, drivers, rescue personnel, and persons in any Area, sponsors, advertisers, owners and lessees of premises used to conduct any rides, surveyors, underwriters, consultants and others persons or entities who give recommendations directions, or instructions or engage in risk evaluation or loss control activities regarding the premises or rides and each of them, their directors, officers, agents, and employees, all for the purposes herein referred to as “Releasees”, FROM ALL LIABILITY TO ME/US, THE MINOR, my/our and the minor’s personal representative, assigns, heirs, and next of kin, FOR ANY AND ALL CLAIMS, DEMANDS, LOSSES, OR DAMAGE ON ACCOUNT OF ANY INJURY TO THE MINOR, including, but not limited to, death, or damage to property, CAUSED OR ALLEGED TO BE CAUSED, IN WHOLE OR IN PART, BY THE NEGLIGENCE OF THE “RELEASEES” OR OTHERWISE.

If, despite this release, I/we, the Minor, or anyone on the Minor’s behalf, makes a claim against the “Releasees” named above, I/WE AGREE TO INDEMNIFY AND SAVE AND HOLD HARMLESS THE RELEASEES and each of them from ANY LITIGATION EXPENSES, ATTORNEY FEES, LOSS, LIABILITY, DAMAGE, OR COST THEY MAY INCUR DUE TO THE CLAIM MADE AGAINST ANY OF THE “RELEASEES” NAMED ABOVE, WHETHER THE CLAIM IS BASED ON NEGLIGENCE OF THE RELEASEES OR OTHERWISE.

I/we sign this agreement on my/our own behalf and on the behalf of the Minor.

IN CONSIDERATION of my minor child (“the minor” being permitted to access in any way in the EVENT(S) and or being permitted to enter for any purpose any RESTRICTED AREA(S), defined to be any area which requires special authorization, credentials or permission to enter or any area to which admission by the general public is restricted or prohibited). I agree:

1) I know the nature of the EVENT(S) and the Minor’s experience and capabilities, and believe the Minor to be qualified to participate in or be in the restricted area(s) of the Event’s. I will inspect the premises, facilities, and equipment to be used, or with which the Minor may come in contact. IF I OR THE MINOR BELIEVE ANYTHING IS UNSAFE, I WILL INSTRUCT THE MINOR TO IMMEDIATELY LEAVE THE RESTRICTED AREA AND REFUSE TO PARTICIPATE IN THE EVENT(S).

2) I FULLY UNDERSTAND and will instruct the Minor that: (a) THE ACTIVITIES OF THE EVENT(S) ARE VERY DANGEROUS and participation in the Event(s) and/or entry into the Restricted Areas involves RISKS AND DANGERS OF SERIOUS BODILY INJURY, INCLUDING PERMANENT DISABILITY, PARALYSIS AND DEATH (“RISKS”); (b) these Risks and dangers may be caused by the Minor’s own actions, or inactions, the actions or inactions of other participating in the Event(s), THE RULES OF THE Events(s), the condition and layout of the premises and equipment, or the NEGLIGENCE OF THE “RELEASEES”; (c) there may be OTHER RISKS NOT KNOWN TO ME or that are not readily foreseeable at this time; and (d) THE SOCIAL AND ECONOMIC LOSSES and/or damages that could result from those Risk(s) COULD BE SEVERE AND COULD PERMANENTLY CHANGE THE MINOR’S FUTURE.

3) I consent to the Minor’s participation in the Event(s) and/or entry into restricted areas and HEREBY ACCEPT AND ASSUME ALL SUCH RISKS, KNOWN AND UNKNOWN, AND ASSUME ALL RESPONSIBILITY FOR THE LOSS, COST AND/OR DAMAGES FOLLOWING SUCH INJURY, DISABILITY, PARALYSIS OR DEATH, EVEN IF CAUSED, IN WHOLE OR PART, BY THE NEGLIGENCE OF THE “RELEASEES”.

4) I HEREBY RELEASE , DISCHARGE AND COVENANT TO NOT SUE the promoters, participants, racing association, sanctioning or any subdivision thereof, track operators, track owners, officials, bike owners, drivers, pit crew, rescue personnel, and persons in any Restricted Area, promotors, sponsors, advertisers, owners and lessees of premises use to conduct the Event(s), premises or event inspectors, surveyors, underwriters, consultants and other persons or entities who give recommendations, directions, or instructions or engage in risk evaluation or loss control activities regarding the premises or Event(s) and each of them, their directors, officers, agents and employees, all for the purposes herein referred to as “Releasees”, FROM ALL LIABILITY TO ME, THE MINOR, my minor’s personal representative, assigns, heirs, and next of kin, FOR ANY AND ALL CLAIMS, DEMANDS, LOSSES, OR DAMAGE ON ACCOUNT OF ANY INJURY TO ME OR THE MINOR, including but not limited to, death, or damage to property, CAUSED OR ALLEGED TO BE CAUSED, IN WHOLE OR IN PART, BY THE NEGLIGENCE OF THE “RELEASEES” OR OTHERWISE.

5) If, despite of this release, I, the Minor, or anyone on the Minor’s behalf, makes a claim against the “Releasees” named above, I AGREE TO INDEMNIFY AND SAVE AND HOLD HARMLESS THE RELEASEES and each of them from ANY LITIGATION EXPENSES, ATTORNEY FEES, LOSS, LIABILITY, DAMAGE, OR COST THEY MAY INCUR DUE TO THE CLAIM MADE AGAINST ANY OF THE “RELEASEES”, WHETHER THE CLAIM IS BASED ON NEGLIGENCE OF THE RELEASEES OR OTHERWISE.

6) I sign this agreement on my own behalf and on the behalf of the Minor.

The BMC Board, in an attempt to accommodate requests from a number of club members, has established a procedure to allow limited riding access to the BMC grounds to those persons that are not current members of the Billings Motorcycle Club. Because of the liability exposure faced by the club as owners of the South Hills property when allowing access to its property for use by those riding high powered motorcycles and quads, it is extremely important that the procedures be followed with no exceptions.

Requirements

– Any riding non-member must be sponsored by a current Regular or Life BMC member in good standing.

– The Sponsor Member must request permission in person from the BMC Board to bring a riding visitor onto the property. To allow sufficient time to get the paperwork in order, requests should be made at least two weeks prior to the riding / access date requested.

– The request to the Board must be in writing on a Non-Member Access Release form. This form is to include the visitor’s name, purpose and date of the visit, and the Sponsor Members name, current contact telephone number and BMC number. The request is to be signed and dated by the Sponsor Member. The Non-Member Access Release form will be provided to the Sponsor Member at the Board meeting when approval for the nonmember visit is approved.

– Following preliminary approval by the Board, the request must be followed within 5 days with the signed, dated and notarized NonMember Access Release form. The completed form must be mailed or hand delivered to any BMC Board member. Because of the need for an original set of signatures and notarization, fax and e-mail are not acceptable with the finalized form. BMC Mailing Address is: PO BOX 20421, Billings MT 59104-0421

– Upon receipt, the Non-Member Access Release form will be reviewed for accuracy and completeness. If there are any issues to be corrected, the Sponsor Member will be contacted at the telephone number shown on the Non-Member Access Release form. If the Sponsor Member cannot be reached and/or the issues are not corrected at least 7 days prior to the date of the requested access, the access will not be allowed.

– Upon approval of the Non-Member Access Release form, Sponsor Member will be provided with a special wristband. The wristband will bear the non-member’s name and the date of the approved access. The nonmember guest is to wear the wristband at all times while they are on the BMC grounds.

– The Sponsor Member will agree to accompany the non-member at all times while on the BMC grounds (at within line of sight). The Sponsor Member will agree to take full and direct responsibility for the BMC grounds, tools and equipment as well as the non-member guest.

– The Sponsor Member will agree to notify a BMC Board member of any incident, accident or injury to the non-member while on or immediately approaching or departing the BMC grounds. In all cases it is the responsibility of the Sponsor Member to provide telephone notice to a BMC Board member within 24 hours of any such incident. This is necessary to allow for accident scene investigation, timely reporting of an injury event (if deemed necessary) to the club’s insurance representative, etc.

– Regular or Life BMC Members in good standing are limited to no more than (2) NonMember Access Passes per year. Associate and Additional Family members do not qualify for the Non-member Access program. This limitation does not apply to the Annual Parental Approval of Minor Relative (the grandchild) policy.

– Members found in violation of this policy will be subject to membership action, up to and including discharge, pursuant to the By-Laws of the club.

This release is for the benefit of the BILLINGS MOTORCYCLE CLUB, lNC., its owners, agents, officers, directors, employees and servants, all hereafter referred to as “BMC.”

I, the undersigned, being 18 years of age or older, understand the inherent dangerous risks involved with attending, watching, helping with or participating in the operation of any motorized vehicles, rides and competitive racing events. I agree that by applying to ride on the grounds of the BMC, I acknowledge such inherently dangerous risks and willingly proceed at my own risk and peril. Therefore, I agree to indemnify and hold forever harmless the BMC from any and all claims of any nature and from any and all liability for any loss, damage, accident injury or death, or any combination thereof, that may occur in connection with the operation of motorized vehicles on the BMC grounds, including riding or while participating in any riding activity or otherwise arising while I am on the BMC grounds. The BMC does not provide medical, emergency transportation or other types of insurance coverage. I agree that the BMC has urged me to not participate in any activities on the BMC grounds unless I have obtained adequate medial insurance coverage.

I know and understand that the property to be ridden upon is undeveloped, unimproved and natural terrain. I understand that the condition of the trails, roads, tracks and other surfaces change frequently due to weather and other reasons, and accept the inherently dangerous conditions of the property.

I grant my express permission to BMC to contact emergency services, including medical doctors and emergency transportation services, for the purpose of administering aid, if BMC is present and determines such services are necessary, in the event of my being injured on the BMC property. I agree to pay for all medial and emergency transportation services invoiced by the provider. I acknowledge that the BMC has no liability for contacting or failing to contact medical or emergency services on my behalf and is not obligated to do so.

I hereby waive any and all claims, and demands for payment of damages against the BMC arising or in connection in any way with my use of the BMC property and BMC’s contact with emergency medical or emergency transportation services or failure to make such contact.

I have read and understand the BMC rules and by-laws and agree to follow the rules and by-laws as currently published and as amended from time to time.
